How many people get H1-B Visas?
Congress has placed a cap on the number of H-1B visas provided annually since the visas establishment in 1990. Currently, the yearly limit stands at 65,000 visas. However, there is an additional 20,000 H-1B visas exclusively for foreign workers who graduated from a U.S. college or university with a master’s degree or doctorate. Although the number varies yearly, around 200,000 H-1B applications are submitted to the US government. These caps are not applicable to certain areas of employment such as institutions of higher learning, nonprofit organizations, and government employment.

It’s a good idea to submit all of the extra paperwork with the standard Form I-129 petition for the H-1B visa.

The H-1B visa application process begins by setting up an account with USCIS to enter the lottery. Even if you already have a USCIS account, you’ll need to create a unique profile for the H-1B registration process. You’ll need to provide some basic information about yourself, your potential employer, the role, and more. This part of the registration process also requires the payment of an application fee. You can enter this information on your own or have it filled in on your behalf by an attorney. There are only 14 days out of the entire year for the registration process. How long can you stay in the U.S. with an H-1B Visa?
An H-1B visa can permit you to live and work in the U.S. for up to 3 years. However, it’s common to extend this time period so long as the initial requirements are still being met. Even then, it’s not common to see an extension beyond 6 years. If your employer ends the working relationship before the end of the H-1B visa, they’ll be responsible for paying the cost of the return to your home country. This doesn’t apply if you terminate the relationship voluntarily.

Recipients of the H-1B visa can have their spouse and unmarried children under 21 years old see admission through the H-4 nonimmigrant visa. It’s important to complete and submit this paperwork as quickly as possible to ensure your family can join you immediately upon approval of your H-1B visa.
